Please read these Terms and Conditions (“Terms”) carefully before using the I Help Canadians website and related online services (the “Service”) operated by I Help Canadians (the “Organization”, “we”, “us” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you must not access or use the Service.
These Terms apply to all visitors, users, donors, and others who access or use the Service.
1. Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these Terms and may result in immediate suspension or termination of your account.
You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password, whether your password is used with our Service or with a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of I Help Canadians and its licensors.
The Service is protected by copyright, trademark, and other laws of Canada and other jurisdictions. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

The Service may contain links to third-party websites or services that are not owned or controlled by I Help Canadians.
We have no control over, and assume no responsibility for, the content, privacy policies, security practices, or operation of any third-party websites or services. You acknowledge and agree that I Help Canadians shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused in connection with the use of, or reliance on, any such content, goods, or services available on or through any such websites or services.
You are strongly encouraged to review the terms and conditions and privacy policies of any third-party websites or services that you visit.
I Help Canadians has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that I Help Canadians shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
4. Termination
We may terminate or suspend your account and/or access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may discontinue using the Service.
Any provisions of these Terms which by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability) shall survive any termination.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall I Help Canadians, nor its directors, officers, employees, volunteers, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to, use of, or inability to access or use the Service;
- Any conduct or content of any third party on or through the Service;
- Any content obtained from the Service; or
- Any unauthorized access to, use of, or alteration of your transmissions, account, or content,
whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if any remedy set forth in these Terms is found to have failed of its essential purpose.
If, despite the foregoing, liability is imposed on I Help Canadians in any circumstance, our total aggregate liability shall not exceed the amount of donations or fees (if any) you have paid directly through the Service in the twelve (12) months preceding the event giving rise to the claim.
6. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
The Service is provided without warranties of any kind, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance.
I Help Canadians, its subsidiaries, affiliates, and licensors do not warrant that:
- The Service will function uninterrupted, be secure, or be available at any particular time or location;
- Any errors or defects will be corrected;
- The Service is free of viruses, malware, or other harmful components; or
- The results of using the Service will meet your expectations or requirements.
I Help Canadians its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
7. Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
These Terms constitute the entire agreement between you and us regarding the Service and supersede and replace any prior agreements regarding the Service.
8. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
If a revision is material, we will make reasonable efforts to provide notice on the Service before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, in whole or in part, you must stop using the Service.

9.0 Donations, Payment Methods, and Fraud Prevention
9.1 Third-Party Payment Processors
Online donations and payments made through the Service may be processed by third-party payment providers (such as payment gateways, credit card processors, financial institutions, or digital wallet providers). These third parties are responsible for the security and processing of your payment information and operate under their own terms, conditions, and privacy policies.
I Help Canadians does not control and is not responsible for the acts or omissions of these third-party providers. By making a donation or payment, you agree to be bound by the applicable terms and policies of the relevant third-party provider.
9.2 Authorized Use of Payment Methods
By submitting a donation or payment through the Service, you represent and warrant that:
- You are the lawful owner of, or are duly authorized to use, the credit card, debit card, bank account, digital wallet, or other payment method you provide; and
- You are not using any stolen, compromised, misappropriated, or otherwise unauthorized payment credentials.
You are solely responsible for ensuring that your payment information is accurate and up to date.
9.3 Fraudulent or Unauthorized Transactions
I Help Canadians does not knowingly accept donations or payments made using stolen, compromised, or otherwise unauthorized payment methods.
We reserve the right, at our sole discretion and at any time, to:
- Refuse, cancel, or reverse any donation or payment;
- Place a hold on funds;
- Request additional information or verification from you; and/or
- Take any other action we consider appropriate,
where we suspect fraud, unauthorized use, chargeback risk, money laundering risk, or any breach of these Terms or applicable law.
Any decision to refuse, cancel, or reverse a donation or payment may be made without prior notice to you, subject to applicable law.
9.4 Limitation of Liability for Unauthorized Use
To the maximum extent permitted by applicable law, I Help Canadians, its directors, officers, employees, volunteers, and agents shall not be liable for any loss, damage, cost, charge, penalty, or claim arising out of or relating to:
- The use of a stolen, compromised, or unauthorized payment method by any third party; or
- Any fraudulent or unauthorized transaction processed in good faith by us or by our third-party payment providers based on information supplied through the Service.
Any dispute regarding unauthorized or fraudulent transactions (including refunds, chargebacks, or recovery of funds) is strictly between you and your bank, card issuer, payment provider, or the person whose credentials were misused.
9.5 Compliance, Anti-Fraud, and Anti-Money Laundering Measures
We may be required by law or by our agreements with payment providers and financial institutions to implement fraud-prevention, anti-money laundering (AML), and sanctions-screening measures. You agree that:
- Your donations or payments may be subject to screening, monitoring, or review; and
- We may be required to delay, block, freeze, or return funds, or to report transactions to financial institutions, regulators, or law enforcement authorities, where we believe this is necessary to comply with applicable laws or contractual obligations.
We may request additional information or documentation from you to verify your identity, the source of funds, or the legitimacy of a transaction. Failure to provide such information may result in refusal, cancellation, or reversal of a donation or payment.
9.6 Cooperation with Law Enforcement and Investigations
We may report suspected fraud, misuse, or criminal activity to payment providers, financial institutions, regulators, and law enforcement authorities, and will cooperate with any investigation as required by law.
Where legally permitted, we may also share information with other charities, NFPs, or partners to help prevent fraud or misuse of charitable platforms.
9.7 No Waiver of Mandatory Rights
Nothing in this Section 10 is intended to exclude or limit any rights or remedies you may have under applicable consumer protection, financial services, or charity laws that cannot be excluded or limited by contract.
